The costly anti-piracy lesson Sony failed to learn from Microsoft

Sony is in the news right now. It has taken several security researchers to court, after they released code circumventing the company's digital rights management (DRM) technology. Unfortunately for Sony, this problem could have largely been avoided had it learned from Microsoft's lessons.

The Sony Playstation 3 caught the eye of the technical community when it first came out. The IBM Cell microprocessor is absolutely fantastic at floating point math, which in addition to calculating pretty video game graphics, makes it a great platform for bioinformatics, brute force cryptography, and astrophysics. Sony long encouraged these alternate uses for the PS3 platform, by including the OtherOS feature in its software, which made it easy to install Linux.

Unfortunately for those users who quite liked being able to use their living room game console as a mini-supercomputer, in April 2010, Sony took away the feature with the release of the 3.21 firmware update. Users were thus given a choice. If they kept the old firmware, they got to keep using Linux, but lost access to Sony's Playstation Network, and the ability to play games online. Alternatively, users could upgrade the firmware, keep playing new titles, but lose access to the Linux functionality.

Many users were unsurprisingly angry, and some even sued the company. Other users took matters into their own hands.

Fast forward to December 2010, when a team of European security researchers revealed that they had broken the Playstation 3's cryptographic code signing technology (which stopped software running on the platform unless Sony had blessed it). The video of the talk is worth watching (part 1, 2, 3), but the most interesting thing for me came later, in a comment posted by one of the researchers to the geek news site slashdot.org:
However, as a whole, the entire PS3 architecture is terrible. Especially after breaking it open and properly analyzing it and finding a ton of screwups (many critical), there is absolutely no doubt in our mind that the sole reason why the PS3 lasted this far is because OtherOS kept all the competent people happy enough not to try to break into the system (that, and maybe hype around their hypervisor and isolated SPE security, both of which turned out to be terribly bad). If you watch the talk you'll actually see that we make this point clear and address the time-to-hack of the PS3. Given our experience and what we've learned from people who work on console hacks, almost nobody tried until OtherOS was removed, so the only valid measurement for "time to hack", as a strength-of-security measure, is the time since OtherOS was removed (9-12 months or so).

OtherOS was Sony's single best security feature.

In hindsight, taking away OtherOS doesn't seem to be too smart of a decision on Sony's part. However, if they had paid attention to the experiences that Microsoft's XBox team had in dealing with the open source community, perhaps the Playstation 3 DRM flaws would never have been found.

From a law journal article I published in 2007:
Microsoft opted to protect its platform against [those wishing to evade region controls on legitimately purchased games, hobbyist gamers, open source hackers, and software pirates] with one technical solution: any software that ran on the XBox needed to be "digitally signed" by Microsoft. Without a valid digital signature, the software would be rejected by the Xbox. To protect its revenue, Microsoft would only issue a digital signature to those software firms that obtained a license from Microsoft and thus agreed to pay royalties.

The problem of this approach, of course, is that the four different groups, which would normally have very little in common, were now motivated to share information and target the one security system holding them back. While those users who wished to play illegal copies of games were motivated by their desire to avoid paying for software, the other three groups had more personal motivations: creativity, and the desire to do what they felt was their right. Furthermore, both the Linux community and the hobbyist game developer community include skilled and motivated programmers — who by definition — spend their time working on projects for free. In creating a single DRM system, Microsoft inadvertently aligned the "software pirates" with a team of skilled open-source programmers with significant experience in reverse engineering proprietary systems. This is the very same design mistake that was made by the creators of the DVD DRM system.

The first breach of Microsoft’s DRM came from the mod-chip community, but did not pose a significant threat to Microsoft due to the difficult process that installing such a chip required. In July of 2003, the Free-X project announced that its members had figured out a way to get Linux running on the XBox without any hardware modifications. The developers were able to exploit a flaw in one of the system’s games using a "buffer overflow," a technique commonly used in the computer security community. Once they had successfully created a software-based hack, the Linux developers gave Microsoft an ultimatum: release a digital signature for the Linux operating system, which would enable users to legitimately run Linux on the Xbox without having to evade the DRM system or else the developers would release a working implementation of the evasion system to the Internet.

Microsoft refused and so the developers made good on their threat. Other developers took advantage of this information, and thus a number of development communities sprung up around the Xbox. This included the Xbox Media Center, an open-source media player capable of playing videos, multi-region DVDs, streaming video and radio from the Internet, and podcasts. Those wishing to play copied games, both fair use backups and illegal copies, also benefited. In many ways, the software pirates were able to free-ride on the efforts of the Linux hobbyists, although Microsoft attempted to portray them in the media as one and the same.

Microsoft: Competing on privacy?

Last week, Dean Hachamovitch, the Corporate VP at Microsoft in charge of Internet Explorer was interviewed on stage at the Consumer Electronics Show (CES) in Vegas. He was there to discuss the next version of the company's browser, and spent most of his time talking about his firm's commitment to privacy. Clearly not a fan of subtlety, Hachamovitch wore a t-shirt with the word "private" printed on it in large letters (the IE logo took the place of the letter e).



A few years ago, advertising executives within Microsoft puled rank and forced the IE team to sabotage an otherwise pretty cool anti-tracking feature in IE8. After the company was rightfully savaged by the Wall Street Journal earlier this summer when it exposed the tale, Microsoft has now decided to offer a far more effective anti-tracking tool in IE9.

As I explained at length in a blog post last month, Microsoft has decided to try to compete on privacy, likely because it is an area which one of its main competitors (Google) is rather weak. During his interview at CES, Hachamovitch himself was quite happy to take potshots at Google, and the fact that the firm's advertising business is dependent upon facilitating, not stopping tracking of users.
Q: A cynical journalist might suggest that you’re embracing privacy and wearing a shirt because Firefox et al are eating your lunch.

A: Paying Windows customers want a great experience that includes privacy, including through their browser. But another way to view people who use browsers is that they’re objects to be boxed and sold. We don’t believe that. We believe Windows customers should have a great experience with their browser.

Q: As opposed to?

A: Well, Chrome, for instance, is funded by advertising.
While I of course believe that Microsoft's new found religion on privacy is motivated by a desire to compete against Google, I see no reason to think that its commitment to "privacy" is anything but genuine. The problem lies with Microsoft's definition of privacy.

When Microsoft talks about the ways that it is innovating and shipping technologies designed to protect its users privacy, it is talking about online tracking, not law enforcement and intelligence agencies that regularly request and obtain private user data. However, as proven by the NSA warrantless wiretapping scandal, and the FBI's repeated abuse of its own surveillance powers, the threat to user privacy from the government is very real. Likewise, as Twitter demonstrated through its bold actions in fighting to have a court order for wikileaks related data unsealed last week, companies can play a vital role, if they choose to do so, in protecting users.

The problem is that Microsoft, like so many firms, has a very narrow definition of privacy. To quote from my latest law journal article:
With few exceptions, the companies to whom millions of consumers entrust their private communications are committed to assist in the collection and disclosure of that data to law enforcement and intelligence agencies – all while simultaneously promising to protect their customers’ privacy.

When these firms speak about their commitment to protecting their customers’ privacy, what they really mean is that they will protect their customers’ data from improper access or use by commercial entities. The fact that these firms have a limited definition of privacy is not made clear to consumers, who may mistakenly believe that the companies to whom they entrust their data are committed to protecting their privacy from all threats, and not just those from the private sector.

It would be bad enough if Microsoft were just ignoring privacy threats from the government, but as I will now explain, the company has repeatedly gone out of its way to assist law enforcement and intelligence agencies in their effort to investigate users. It has put the interests of the government over the privacy of its regular customers.

How Microsoft sacrifices user privacy in order to assist the government

When asked in 2007 by the New York Times if the company was considering a policy to log no search data at all, Peter Cullen, Microsoft’s chief privacy strategist argued that too much privacy was actually dangerous. "Anonymized search," he said, "can become a haven for child predators. We want to make sure users have control and choices, but at the same time, we want to provide a security balance."

Similarly, the company proactively appends the IP address of each Hotmail user's personal computer in the headers of every outbound email. This is not required by any technical standard, and is a purely voluntary act on Microsoft's part. As far as I am aware, Microsoft and Yahoo are the only two major email providers that do this, and the end result is that law enforcement agencies can determine the IP address of the user who sent any Hotmail originated email and thus go directly to the user's ISP to determine their identity, without having to go to the trouble of contacting Microsoft first.

Microsoft has also developed computer forensics software which it freely distributes to government agencies, allowing them to easily extract private data from seized Windows computers. As the company states on the webpage for the COFEE forensics tool, "If it's vital to government, it's mission critical to Microsoft."

Finally, the most frustrating thing for me personally, is Microsoft's position on disk encryption. Microsoft considers BitLocker disk encryption a "premium" feature, and restricts it to only those consumers who buy the Ultimate version of Windows 7. For consumers using the copy of Windows 7 Home Premium that came with the new PC they bought at Staples, the cost of the Ultimate upgrade is $139.95.

In contrast, Google has opted to ship disk encryption enabled by default on its new Chrome OS platform, and both Apple and Ubuntu Linux both include encryption with their systems by default (to be enabled with a single checkbox during or after installation).

The end result of Microsoft's decision is that few regular consumers use BitLocker, and instead, those who do wish to use some form of disk encryption generally seek out third party software, like TrueCrypt.

I would be extremely surprised if Microsoft has extracted much additional profit through this decision. So much so that I suspect that money is not the reason for doing this. Instead, I suspect (and have heard rumors from insiders at Microsoft suggesting so) that it is an intentional move designed to limit the widespread adoption of encryption by regular users.

The man who either made this product decision, or played a significant role in influencing it is Scott Charney, Microsoft's Corporate VP in charge of Trustworthy Computing. Before coming to Microsoft, Charney was a prosecutor in the Department of Justice and served as Chief of the Computer Crime and Intellectual Property Section (CCIPS).

Easy to enable (or worse, deployed by default) disk encryption would seriously frustrate the investigative abilities of the law enforcement community, including many of his former colleagues.

What this means

Based on its current actions, it is clear that Microsoft is not interested in protecting its users from government intrusions into their privacy. Yes, the company has played a significant role in the Digital Due Process coalition, and executives have testified multiple times before Congress in the last year supporting the reform of the Electronic Communications Privacy Act (these actions on Microsoft's part are not entirely altruistic. Updating electronic privacy law would give consumers and businesses more of a reason to entrust their private data to Microsoft's cloud services). However, such reforms (while an improvement) will only require that a judge approve the disclosure of data held in the cloud. If a judge says OK, the data will still be handed over.

As a software and technology company, Microsoft is in a fantastic position to actually offer solid protection to end users and embrace privacy by design. It can make use of limited (or zero) data retention periods, use encryption wherever possible, by default, to make sure that seized data is useless to anyone but its owner, and instead of building forensics software to extract data from Windows computers, the company should be hardening Windows so that all forensics software tools are unable to extract anything of value.

The problem for Microsoft (and so many other large companies), is that pissing off national and state governments isn't good for business, particular when they are some of your largest customers. Furthermore, for a firm that is so actively engaged in Washington DC, any moves that seriously frustrate law enforcement interests would likely consume political capital that could otherwise be used lobbying for things that will actually improve the company's profits.

As such, I don't seriously expect Microsoft to fully embrace privacy, or to deploy any technology that will seriously frustrate law enforcement agencies. I'm not going to waste my time trying to argue that the company should do this. What I will argue though, is that the company should not be permitted to loudly advertise its commitment to privacy, when it is clearly not the case. The company's claims, quite simply, are false and deceptive. At the very least, the company should have to clarify its definition of privacy, and acknowledge, prominently, that it has opted to not protect users from government threats.

This is where the FTC (or other countries' consumer protection agencies) can and should play a role, if they wished. While companies have no obligation to protect their customers from government surveillance, they are at least obligated to make truthful statements when describing their products, particularly when the firms proudly advertise privacy as a major feature.

Thoughts on the DOJ wikileaks/twitter court order

The world's media has jumped on the news that the US Department of Justice has sought, and obtained a court order seeking to compel Twitter to reveal account information associated with several of its users who are associated with Wikileaks.

Communications privacy law is exceedingly complex, and unfortunately, none of the legal experts who actually specialize in this area (people like Orin Kerr, Paul Ohm, Jennifer Granick and Kevin Bankston) have yet to chime in with their thoughts. As such, many commentators and journalists are completely botching their analysis of this interesting event. While I'm not a lawyer, the topic of government requests to Internet companies is the focus of my dissertation, so I'm going to try to provide a bit of useful analysis. However, as always, I'm not a lawyer, so take this with a grain of salt.

A quick introduction to the law

On December 14, An Attorney in the US the Department of Justice obtained a court order compelling Twitter to reveal records associated with several of its users. The order, issued under 18 USC 2703(d) is not a subpoena (even though the AP, New York Times, Salon and many other outlets have reported that it is). Subpoenas are essentially letters written by law enforcement officers, on official agency letterhead, and have not been reviewed or signed by a judge. The 2703(d) order in question was issued by a magistrate judge.

Per the statute, a judge isn't supposed to issue a 2703(d) order unless the government "offers specific and articulable facts showing that there are reasonable grounds to believe that the contents of a wire or electronic communication, or the records or other information sought, are relevant and material to an ongoing criminal investigation". We don't know what these facts are though -- as it doesn't look as though the government's original request to the court has been made public. (It isn't clear if those records themselves remain sealed. I tried to find the case in PACER, and couldn't locate it, so this will have to wait until Monday, when someone can call up the Clerk's office to ask for the documents).

"d" orders can be used to obtain customer records (name, address, credit card info, IP addresses used to connect to the service), non-content data associated with individual communications (to/from and timestamps from emails, etc). They can also be used to obtain any saved, outbound communications (such as the "sent" mail folder), all communications that are more than 180 days old, as well as those that have been opened and viewed at least once (except in the 9th circuit). If the government wants access to unread messages that are 180 days old or newer, it must seek a rule 41 court order, which requires a showing of probable cause.

The order to twitter

The government's wikileaks "d" order, as the statute permits, requests the customer subscriber info associated with the account (essentially copying this language in full from the statute).



It is the second part of the order that is more interesting. Again, as the statute allows, the government is requesting non-content information associated with individual communications. What the government appears to be seeking in part 2 is the metadata associated with every Twitter communication to and from the users named in the order. What this means is up to debate. It could mean the name and timestamp of every user who has sent or received a private message to one of the named individuals. It might also mean the list of individuals who have publicly communicated, or mentioned the named individual, or who have been named in a tweet by those persons. It might even include a list of followers, although this information is public already, so it is unclear why the government would seek it through a court order.



The statute (and caselaw) permits the government to use a "d" order to get access to communications older than 180 days, those that have been read at least once (outside the 9th circuit), and saved outgoing messages. What isn't so clear to me though, is if the government has requested this information from Twitter or not when it asks for "correspondence and notes of records related to the accounts".

My initial impression is that this is not a request for communications content, but communications between the user and twitter itself (for example, customer service inquiries). However, I'm not really sure about this though... so I'll wait for the real experts to weigh in on this bit.

Reading between the lines

With that discussion of the law out of the way, lets get to the fun part: Speculation. Based on this order, and the events that followed, there are some interesting observations to be made.

1. Amateur Hour. The 2703(d) order misspelled the names of one of the targets, Rop Gonggrijp. It also requested credit card and bank account numbers of several Twitter users, even though Twitter is a free service and so doesn't have such information (presumably someone at DOJ knows a little about Twitter, since the agency has 350,000 followers of its official Twitter account).

The Department of Justice prosecutor named in the order, Tracy Doherty-McCormick, was prosecuting online child exploitation cases just five months before the Twitter order was issued. Given that the wikileaks investigation is the most high-profile national security investigation of the decade, and that the court order seeks records associated with an Icelandic member of parliament, you would think that DOJ would assign this case to someone more senior.

From my own experience, outside of the Computer Crime & Intellectual Property Section (CCIPS) and the National Security Division, most DOJ attorneys know very little about technology. As such, it may simply be that Doherty-McCormick, through her experience in prosecuting pedophiles caught in online stings, may be the most tech savvy prosecutor in her office, and thus could have been brought in to help with the investigation on that basis alone.

However, the technical knowledge involved in tricking a pedophile into meeting what he believes is a 13 year old girl isn't quite the same as is required by someone investigating a sophisticated organization run by skilled computer security researchers. Presumably, Doherty-McCormick is in regular communication with tech-savvy attorneys from CCIPS, who are likely assisting in this matter.

2. Three of the individuals named in the order, Jacob Appelbaum, Rop Gonggrijp, and Julian Assange are computer security experts - Appelbaum has worked with the Tor project, and has co-authored some pretty awesome encryption research, Assange co-authored a deniable encrypted filesystem, and Rop has worked for several years to create mobile phone encryption software. All three likely use strong encryption to store and transmit sensitive communications and use Tor to mask their IP addresses. As such, I'm not really sure what DOJ hopes to gain by asking Twitter for this data -- as it is doubtful that these individuals have entrusted Twitter with anything private.

3. Why the "d" order? For a case this high profile, it is quite shocking that the government is using a "d" order to try and gather information. At least for Assange and Manning, surely there is sufficient evidence already to demonstrate probable cause, and get a rule 41 warrant, which could be used to get full communications content and prospective location information? What is even more surprising though, is that criminal statutes are being used, and not foreign intelligence laws. To be perfectly frank, I would have bet money that DOJ had already obtained a FISA order to monitor Assange and any of his associates. I really don't know what to make of this.

4. Twitter. The bigger story here, IMHO, far more interesting than the government request for wikileaks related info, is the fact that Twitter has gone out of its way to fight for its users' privacy. The company went to court, and was successful in asking the judge to unseal the order (something it is not required to do), and then promptly notified its users, so that they could seek to quash the order. Twitter could have quite easily complied with the order, and would have had zero legal liability for doing so. In fact, many other Internet companies routinely hand over their users' data in response to government requests, and never take steps to either have the orders unsealed, or give their users notice and thus an opportunity to fight the order.

Alex Macgillivray, Twitter's general counsel is clearly behind this strong, pro-privacy move. Macgillivray was one of the first law students at Harvard's Berkman Center. Until he moved to Twitter, he worked on copyright and privacy issues at Google, where, he played a major role in getting the company to contribute takedown requests to chillingeffects.org. Not surprisingly, Twitter recently started sending copies of takedowns to chillingeffects too.

It is wonderful to see companies taking a strong stance, and fighting for their users' privacy. I am sure that this will pay long term PR dividends to Twitter, and is a refreshing change, compared to the actions by some other major telecommunications and internet application providers, who often bend over backwards to help law enforcement agencies. Simply put, the contrast between Amazon, Paypal (owned by eBay) and Twitter couldn't be clearer.

As one further example of this difference, consider Twitter's actions here in contrast with comments from eBay's director of compliance a few years back:
We [eBay] try to make rules to make it difficult for people to commit fraud and easy for you [law enforcement agencies] to investigate. One is our Privacy policy. I know from investigating eBay fraud cases that eBay has probably the most generous policy of any internet company when it comes to sharing information. [emphasis added]

We do not require a subpoena except for very limited circumstances. We require a subpoena when we need the financial information from the site, credit card info or sometimes IP information.


5. Did the government seek the contents of private messages? As I wrote above, it's not clear if the government sought the content of private messages. Had they sought such information, I would have expected them to be clearer in describing that information. However, based on Twitter's actions in getting the court to unseal the 2703(d) order, had the government sought communications content, I would fully expect to see the company to fight that order, on 4th amendment grounds.

My guess is that the government opted to not ask for such information, purely as a strategic matter, as it probably feared that Twitter would lawyer up, refuse to disclose any communications content, and seek to have that part of 18 USC 2703 ruled unconstitutional. Over the past year or so, several courts have taken a dim view of the government's practice of obtaining various forms of private data without probable cause warrants. A 2703(d) request for content from Twitter would be an ideal opportunity for courts to examine this issue, and would likely have been very risky for the government.

What comes next

This case is extremely high profile -- it involves data privacy; Twitter, arguably the hottest communications service a hot communications tool; wikileaks; and a member of the Icelandic parliament. I fully expect this to go to court, and for absolutely everyone to try and get involved in this case -- privacy groups, communications providers, and perhaps even the Icelandic government will all likely file amicus briefs.

As a privacy advocate and researcher, I can't wait to see this situation develop.
